These Terms of Use ("Terms") govern your use of the Mara: Running Coach mobile application and related services ("App" or "Services") provided by Mara: Running Coach ("we," "us," or "our"). Please read the Terms carefully. By accessing or using our Services, you acknowledge that you accept and agree to be bound by these Terms.

Registration and Eligibility

You must be at least 16 years old to use the App, or such minimum age as permitted under your local law for valid consent. Users under this age may only use the App with verified parental consent, where legally allowed. You are responsible for maintaining the confidentiality of your account and all activity that occurs under it.

Important Disclaimers

Mara is not a medical service. We provide training plans based on data, not medical evaluations. Consult your physician before starting any new exercise regimen. If you are pregnant, have a medical condition, or experience pain or discomfort while using the App, stop immediately and consult a healthcare professional.

In using our Services, you affirm that either your physician has approved your use of the Service or that all of the following statements are true:

1. no physician has ever informed you that you have a heart condition or that you should only do physical activities recommended by a physician
2. you have never felt chest pain when engaging in physical activity
3. you have not experienced chest pain when not engaged in physical activity at any time within the past month
4. you have never lost your balance because of dizziness and you have never lost consciousness as a result of exertion
5. you do not have a bone or joint problem that could be made worse by a change in your physical activity
6. your physician is not currently prescribing drugs for your blood pressure or heart condition
7. you do not have a history of high blood pressure, and
8. you do not know of any other reason you should not exercise.

Privacy

Your use of our Services is subject to our Privacy Policy. Please review it carefully. It includes information about what data we collect, how we use it, and your rights.

Subscriptions and Billing

We may offer paid subscriptions, with or without a trial. Subscriptions auto-renew unless canceled at least 24 hours before the end of the billing period. You can manage or cancel subscriptions via the App Store. Refund policies are governed by the platform from which you purchased the subscription.

License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, reverse engineer, sell, or distribute our Services or content.

User Conduct

You agree not to use the App to violate laws, infringe rights, distribute malware, harass others, or disrupt the operation of our Services. We reserve the right to suspend or terminate accounts violating these rules.

What you can and cannot do. While using our Services you agree not to violate any applicable law, contract, intellectual property or other third-party right or commit a tort, and that you are solely responsible for your conduct while accessing or using our Services.

Specifically, you shall not:

• resell, rent, lease, loan, sublicense, distribute, or otherwise transfer rights to the App
• engage in any harassing, threatening, intimidating, predatory or stalking conduct
• use our Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying our Services or that could damage, disable, overburden or impair the functioning of our Services in any manner
• modify, reverse engineer, decompile or disassemble any part of our Services or do anything that might discover source code or bypass or circumvent measures employed to prevent or limit access to any part of our Services
• copy, adapt, alter, modify, translate, or create derivative works of the Services without the written authorization of the Company
• circumvent or disable any technological features or measures in the App for protection of intellectual property rights
• attempt to circumvent any content-filtering techniques we employ or attempt to access any feature or area of our Services that you are not authorized to access
• develop or use any third-party applications that interact with our Services without our prior written consent, including any scripts designed to scrape or extract data from our Services
• use or access the Services to compile data in a manner that is used or usable by a competitive product or service
• use our Services for any illegal or unauthorized purpose, or engage in, encourage, or promote any activity that violates the Terms, or
• use data, content, or features from the App and the website to diagnose, treat, or mitigate any health conditions

Health and Safety

Use the App at your own risk. We are not responsible for any injuries or health outcomes resulting from use of the Services. You assume full responsibility for any decisions or actions made based on information provided by the App.

Data and AI Usage

Some features are powered by AI models (Google Gemini). Your training data may be temporarily processed to deliver personalized plans. We do not retain identifiable health data post-processing. AI outputs are not a substitute for professional advice.

International Use and Legal Compliance

Our services comply with GDPR. When data is transferred outside the EU/EEA/UK, we use Standard Contractual Clauses (SCCs) and similar safeguards to protect your data.

Termination

We may suspend or terminate your access at any time for violations of these Terms or misuse of the App. You may terminate your account at any time via the App or by contacting us.

Limitation of Liability

To the maximum extent permitted by applicable law, the Services and all content are provided “as is” and “as available” without warranties of any kind, express or implied. We and our affiliates, developers, licensors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your access to or use of, or inability to access or use, the App or Services.

In any event, and to the fullest extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Services will not exceed one hundred U.S. dollars (USD $100), regardless of the cause of action or legal theory, and regardless of whether we were advised of the possibility of such damages.

This limitation applies regardless of the form of action (whether in contract, tort, strict liability, or otherwise), and even if a remedy fails of its essential purpose.

In jurisdictions where exclusions or limitations of liability for consequential or incidental damages are not permitted, our liability shall be limited to the maximum extent allowed by law.

Nothing in these Terms excludes or limits our liability to the extent it cannot be excluded or limited under applicable law, including for:

(a) death or personal injury caused by our negligence;

(b) fraud or fraudulent misrepresentation;

(c) any other liability that cannot be lawfully excluded or limited.

Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes go into effect constitutes your acceptance.
